1. OVERVIEW
This website, etceyewear.com (the "Site"), is operated by ETC Eyewear LLC ("ETC," "we," "us," or "our"). By visiting the Site or purchasing from us, you agree to these Terms of Service ("Terms"), including the policies they reference. If you do not agree, do not use the Site.
2. ELIGIBILITY
You must be at least 18 years old, or the age of majority where you live, to make a purchase. You agree that the information you provide at checkout is accurate and complete.
3. PRODUCTS
ETC sunglasses use CR-39 lenses that are non-polarized and provide UV400 protection. We make every effort to display products accurately, but colors may vary depending on your screen, and frames may show small variations in finish. Product availability is subject to change without notice.
4. PRICING AND MULTI-PAIR PRICING
Prices are listed in U.S. dollars. Pricing is based on the number of pairs in an order, as shown on the Site and in your cart. Multi-pair pricing is applied automatically in your cart. Discount codes, including our welcome offer, may be combined with multi-pair pricing unless the code states otherwise. Only one discount code may be used per order. During sale periods, sale pricing replaces standard pricing. We reserve the right to change prices at any time and to correct pricing errors, including after an order has been placed. If a pricing error affects your order, we will contact you before it ships.
5. ORDERS AND PAYMENT
We may refuse or cancel any order, including orders that appear fraudulent or that exceed quantities we reasonably determine to be for resale. If we cancel an order after payment, we will issue a full refund. Orders cannot be changed or cancelled by the customer once placed.
6. SHIPPING
Shipping terms, rates, and timelines are described in our Shipping Policy. Delivery times are estimates, not guarantees. Title and risk of loss pass to you when the carrier marks the package delivered to the address you provided.
7. RETURNS AND EXCHANGES
Returns and exchanges are governed by our Refund Policy. In summary, eligible items may be returned or exchanged within 14 days of delivery if unworn and in original packaging. Exchanges are free. Returns are refunded less a $9 return shipping and processing fee. When part of a multi-pair order is returned, the refund reflects the price for the number of pairs kept. Items purchased during a sale are final sale.
8. LIMITED WARRANTY
ETC warrants that products purchased from etceyewear.com will be free from defects in materials and workmanship for one (1) year from the order date. This warranty does not cover normal wear and tear, scratched or broken lenses, damage resulting from accident, misuse, or neglect, loss or theft, or products altered or repaired by anyone other than ETC. Proof of purchase is required. If a claim is approved, ETC will replace the product with the same product or, if unavailable, a product of equivalent value. ETC does not provide individual replacement parts. Replacement products are covered for the remainder of the original warranty period. This warranty is non-transferable and applies only to the original purchaser. Except as stated in this section, and to the extent permitted by law, products are provided without other warranties, express or implied.
9. CUSTOMER CONTENT
If you submit a review, photo, or video to us, upload one with a review, or post one that tags ETC or uses our hashtags and then confirm we may use it, you grant ETC a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, edit, and display that content on the Site, in advertising, on social media, and in email, with credit to your handle where practical. You confirm that you own the content and that anyone shown in it has agreed to its use. To ask us to stop using your content, email support@etceyewear.com and we will remove it from future use within a reasonable time.
10. INTELLECTUAL PROPERTY
All content on the Site, including text, images, logos, designs, and product names, is owned by or licensed to ETC and is protected by intellectual property laws. You may not copy, reproduce, or use it for commercial purposes without our written permission.
11. PRIVACY, COOKIES AND ACCESSIBILITY
Our Privacy Policy explains how we collect, use, and share personal information and is incorporated into these Terms. Our Cookies & Data page describes the cookies and similar technologies we use. Non-essential cookies and tracking run only according to the choices you make in our cookie banner, and we honor Global Privacy Control signals where required by law. You may opt out of the sale or sharing of your personal information on our Your Privacy Choices page.
We are committed to making the Site usable by everyone. Our Accessibility page describes our approach and how to reach us if any part of the Site is difficult to use. If you have trouble placing an order online, email support@etceyewear.com and we will help you complete it.
12. PROHIBITED USES
You may not use the Site to violate any law, infringe anyone's rights, transmit malicious code, scrape or collect data without permission, interfere with the Site's operation, or purchase products for unauthorized resale.
13. DISCLAIMER AND LIMITATION OF LIABILITY
Except as expressly stated in these Terms, the Site and products are provided "as is" and "as available." To the fullest extent permitted by law, ETC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products. ETC's total liability for any claim relating to a product will not exceed the amount you paid for that product. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
14. INDEMNIFICATION
You agree to indemnify and hold harmless ETC and its members, employees, and partners from claims arising from your breach of these Terms or your violation of any law or third-party right.
15. GOVERNING LAW
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Orange County, California.
16. CHANGES TO THESE TERMS
We may update these Terms at any time by posting the revised version on the Site. Changes apply to orders placed after the update. Your continued use of the Site after changes are posted means you accept them.
